§ 22-66. Definitions.

  • The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

    Canvasser means any individual who, for himself or for a partnership, association or corporation, goes door to door or stops people on the street for the purpose of determining an opinion poll for a product, to obtain buyers for any franchise business or products or for any other purpose which is related to a commercial enterprise.

    Charitable organization means any benevolent, philanthropic, patriotic or eleemosynary person, partnership, association or corporation or one purporting to be such.

    Direct seller means any individual who, for himself or for a partnership, association or corporation, sells goods or takes sales orders for the later delivery of goods at any location other than the permanent business place or residence of such individual partnership, association or corporation and shall include, but not be limited to, peddlers, solicitors and transient merchants. The sale of goods includes donations required by the direct seller for the retention of goods by a donor or prospective customer.

    Goods means personal property of any kind including goods provided incidental to services offered or sold as well as a service.

    Permanent merchant means a direct seller who, for at least six months prior to the consideration of the application of this article to such merchant, has continuously operated an established place of business in the village or has continuously resided in the village and now does business from his residence.
