§ 2-388. Real property.

  • The board of trustees may, in its discretion, sell, transfer or convey any real property owned by the village pursuant to the authority granted under Wis. Stats. § 61.34(3) utilizing one or more of the following methods:

    (1)

    By sale. The board may advertise real property to be sold and request sealed bids. Requests for bids may require a minimum bid price and, in the discretion of the board, may also establish criteria for the submission of proposals concerning the development and use of the subject real property. In establishing the criteria for proposals, the board shall consider the village's land use plan, as amended from time to time, and such other factors as the board may find which concern the health, safety, welfare and convenience of the public. The board may accept or reject any or all bids and/or proposals and may sell to such bidder who submits the bid/proposal deemed by the board, in its discretion, to be in the best interests of the village. Records shall be kept by the clerk of all property sold in the manner provided in section 2-386(1)a—(1)c.

    (2)

    By public auction. The board may order the sale of real property at a public auction at a date and time established by the board. The property shall be sold to the person who makes the highest bid at the auction; provided, however, that the board may establish a minimum sale price for the property. Such auction shall be conducted under the supervision of the board or its designee. Records shall be kept by the clerk of all property sold in the manner provided in section 2-386(1)a—(1)c.

    (3)

    By other advantageous method. Whenever the board finds that the methods set forth under subsections (1) and (2) of this section are unsuitable for the disposition of real property owned by the village, the board may, in its discretion, transfer any real property of the village in any manner which the board finds will best promote the health, safety, welfare and convenience of the public.
