§ 38-34. Fire inspection.

  • (a)

    The chief shall hold the office of fire inspector, with power to appoint one or more deputy fire inspectors, who shall perform the same duties and have the same powers as the fire inspector.

    (b)

    Pursuant to Wis. Stat. § 101.14, or any amendment, renumbering, or other legal authority, the fire inspectors shall inspect, or cause to be inspected, all places of employment and public buildings, premises and thoroughfares as often as may be necessary, but not less than twice per year.

    (c)

    The purpose of any inspection and/or investigation is to determine if any violations of the provisions or intent of this Code and/or the Codes or standards adopted exist and to order corrections of the violations observed. If a violation is not eliminated within the time allowed, it shall be deemed a nuisance, and the fire chief or his deputy may issue a citation for failure to comply with such order, seek a court-ordered injunction with the assistance of the village attorney, or where necessary, have the nuisance removed by the village. The cost of such removal shall be assessed as a special charge against the property.

    (d)

    The fire inspector shall keep a record of each property inspected which shall conform to the requirements of the Wisconsin Department of Safety and Professional Services.

    (e)

    No person shall deny the chief or his deputies free access, at all reasonable hours, to any place of employment and/or public building within their jurisdiction for the purposes of making any inspection or investigation which, under the provision of this subchapter they shall deem necessary. No person shall hinder or obstruct the fire inspector in the performance of his duty or refuse to observe any lawful directions given by him.

    (f)

    Any owner or occupant of any place of employment and/or public building, who refuses to permit, prevents or interferes with entry into or upon the premises by anyone authorized by the chief under this section who has obtained an inspection warrant pursuant to Wis. Stat. § 66.0119 or any successor statute shall be guilty of violating this chapter and shall be subject to contempt and forfeiture. The interiors of private dwelling units will not be inspected unless an inspection is specifically requested by the owner or occupant and/or as allowed by State Statutes.

    (g)

    Owners of public buildings and places of employment, as those terms are defined under § 101.01, Wis. Stats., shall cause all inspection reports, service records, notices of violation, and any other information requested by the fire inspector, to be filed and fees as established by the village board to be paid as directed by the fire inspector. Property owners who fail to comply with these requirements will be subject to an additional fee as determined by the village board.
