§ 38-64. Obstruction of fire hydrants prohibited.

  • (a)

    Purpose, public nuisance declared. The village board finds that unobstructed access to fire hydrants by fire department and public works personnel is necessary to ensure the health, safety, and welfare of village residents and provide for the safety of property within the village. Therefore, the village board declares that any violation of subsection (b) constitutes a public nuisance.

    (b)

    Obstruction of fire hydrants prohibited.

    (1)

    No person shall plant or maintain any tree, bush, or shrub within ten feet of any fire hydrant in the village.

    (2)

    No person shall obstruct access to any fire hydrant within the village.

    (c)

    Penalties, removal of obstruction. Any person violating this section shall be subject to penalties as set forth in section 1-4 of this Code. Any person violating this section shall also be subject to a request for injunctive relief provided, however, that no notice shall be required for abatement of any public nuisance declared under this section in the event emergency access to any fire hydrant is deemed necessary by the fire chief or his or her designee. Costs of removal of any tree, bush or shrub obstructing any fire hydrant may be assessed as a special charge against the property under Wis. Stats. § 66.0627.
