Chapter 50. LAND DIVISION ORDINANCE |
Article I. IN GENERAL |
§ 50-13. Dedication and reservation of lands.
(a)
Streets, highways and drainageways. Whenever a proposed subdivision, minor land division or condominium plat encompasses all or any part of an arterial or collector street, drainageway or other public way which has been designated on a duly adopted village, county or regional comprehensive plan, or component thereof or the official map of the village, such public way shall be made a part of the plat or certified survey map and dedicated or reserved, as determined by the village, by the subdivider in the locations and dimensions indicated on such plan or map and as set forth in article III of this chapter..
(b)
Parks, playgrounds, and public library sites. Whenever land to be divided within the village encompasses all or any part of a park, playground or library site which may be designated in planning documents for the village, such park, playground or library site shall be made a part of that plat or certified survey map and dedicated or reserved by the subdivider in the locations and dimensions indicated on such plan and in accordance with the procedures set forth in section 50-171.
(c)
School sites. Whenever land to be divided within the village encompasses all or any part of a school site which may be designated in planning documents for the village, such school site shall be reserved in accordance with the procedures set forth in section 50-171.
(d)
Open space. Whenever land to be divided within the village encompasses all or any part of open space lands, as defined in section 50-4 of this chapter, such open space land shall be protected. Acceptable means of protection shall include, but not be limited to, the following:
(1)
Reservation or dedication to the village.
(2)
Conservation easement.
(3)
Deed restriction or restrictive covenant. Common open space to be permanently preserved shall be protected by providing a deed restriction or restrictive covenant that prohibits any land division or development of said open space.
