§ 50-3. Purpose and intent.

  • The purpose of this chapter is to regulate and control the division of land within the corporate limits of the village and its extraterritorial plat approval jurisdiction in order to promote and protect the public health, safety, morals, prosperity, aesthetics and general welfare of the village and its environs. It is the general intent of this chapter, without limitation, to regulate the division of land so as to:

    (1)

    Promote the wise use, conservation, protection and proper development of the village's soil, water, wetland, woodland and wildlife resources, and to achieve a balanced relationship between land use and development and the supporting and sustaining natural resource base;

    (2)

    Lessen congestion in the streets and highways;

    (3)

    Provide proper ingress to and egress from development sites;

    (4)

    Further the orderly layout and appropriate use of land;

    (5)

    Avoid the harmful effects of premature division or development of land;

    (6)

    Provide adequate light and air;

    (7)

    Prevent the overcrowding of land and avoid undue concentration of population;

    (8)

    Facilitate adequate provision for housing, transportation, water supply, stormwater management, sewerage, schools, parks, playgrounds and other public facilities and services;

    (9)

    Secure safety from fire, flooding, water pollution, disease and other hazards and minimize expenditures for flood relief and flood control projects;

    (10)

    Prevent and control erosion, sedimentation and other pollution of surface and subsurface waters;

    (11)

    Preserve natural vegetation and cover and promote the natural beauty of the village;

    (12)

    Preserve and enhance the character of neighborhoods, special-purpose planning districts including the village center/downtown, and the community as a whole;

    (13)

    Restrict building sites in areas covered by poor soils or in other areas poorly suited for development;

    (14)

    Facilitate the further division of larger tracts into smaller parcels of land;

    (15)

    Ensure adequate legal description and proper survey monumentation of divided land;

    (16)

    Provide for the administration and enforcement of this chapter;

    (17)

    Provide penalties for its violation;

    (18)

    Implement those municipal, county, watershed or regional comprehensive plans or their components adopted by the village, including the Village of Hartland Comprehensive and Master Plans and the Hartland Village Center Revitalization Plan, and in general to facilitate enforcement of village development standards as set forth in the adopted regional, county and village comprehensive plans, adopted plan components, and the Village Zoning Ordinance, building code and official map; and

    (19)

    Further the sustainability of the village by promoting, where appropriate, green development and infrastructure.
