§ 50-36. Review and approval of extraterritorial plats and certified survey maps.

  • When it is proposed to divide lands or create condominiums located in the extraterritorial plat approval jurisdiction of the village, the subdivider shall proceed as specified in divisions 2 and 4 of this article, with the following exceptions or additions:

    (1)

    It is recommended that prior to the filing of an application for the approval of a preliminary plat or certified survey map, the subdivider consult with the plan commission and/or village staff in order to obtain their advice and assistance. This consultation is neither formal nor mandatory, but is intended to inform the subdivider of the purpose and objectives of the regulations of this chapter, and any existing village planning documents and ordinances; however, the plat or certified survey will not be reviewed by the village within the context of the land's proposed use. In so doing, both the subdivider and the village may reach mutual conclusions regarding the general program and objectives of the proposed development and its possible effects on the neighborhood and community. The subdivider will gain a better understanding of the subsequent required procedures. The subdivider shall specify in his letter of application to whom the original application was submitted.

    (2)

    If the subdivider elects to initially submit the proposed plat or certified survey map to the village, the plat or certified survey map shall be first submitted by the subdivider to the town clerk concerned. The town clerk shall then assume the responsibility for transmitting the plat or map to the objecting agencies and other approving authorities, including the village.

    (3)

    Approving agencies include the village board, town board, and Waukesha County Planning Agency; and the subdivider must comply with the land division ordinances of the village, town, and county.

    (4)

    The subdivider may proceed with the installation of such improvements and under such regulations as the town board of the town within whose limits the plat lies may require. Wherever connection to any village utility is desired, permission for such connection shall be subject to village board review and approval.

    (5)

    All improvement requirements specified by the town board or any special improvements district in matters over which they have jurisdiction shall be met before the final plat is filed.
