§ 50-72. Review and approval.

  • (a)

    The objecting agencies shall, within 20 days of the date of receiving their copies of the preliminary plat, notify the subdivider and all other approving and objecting agencies of any objections. If there are no objections, they shall so certify on the face of the copy of the plat and shall return that plat copy to the clerk. If an objecting agency fails to act within 20 days, it shall be deemed to have no objection to the plat.

    (b)

    The plan commission shall promptly review the preliminary plat, after objections and comments have been received by the objecting and reviewing agencies and officials, for conformance with this chapter and all applicable laws, ordinances and comprehensive plans and components thereof. The plan commission shall comment and recommend action on the preliminary plat to the village board. If the plan commission approves the preliminary plat, this recommendation shall be submitted to the village board along with a statement of the conditions upon which the approval was based and identify site improvements, if any, that should be made prior to the approval of the final plat. The preliminary plat, along with the recommendations, shall be considered by the village board at its next regular meeting.

    (c)

    The village board, with or without the recommendations of the village engineer/DPW director, plan commission and the objecting or approving agencies, shall, within 90 days of the date of filing of a preliminary plat with the village clerk, approve, approve conditionally or reject such plat by written notification, unless the time is extended by mutual written agreement with the subdivider. A certified copy of this resolution with the date and action endorsed thereon, along with a copy of the preliminary plat, shall be sent to the subdivider. One copy each of the plat and letter shall be placed in the plan commission's permanent file.

    (d)

    Failure of the village board to act within 90 days shall constitute an approval of the plat, as filed, unless the review period is extended by mutual consent.

    (e)

    Approval or conditional approval of a preliminary plat shall not constitute automatic approval of the final plat, except that if the final plat is submitted within 36 months of preliminary plat approval and conforms substantially to the preliminary plat, including any conditions of that approval, and to local plans and ordinances, the final plat shall be entitled to approval as provided in Wis. Stats. § 236.11(1)(b). The village board may extend the time for submission of the final plat.
