§ 50-170. Protection of natural resources.

  • Where natural drainage channels, floodplains, wetlands or other environmentally sensitive areas are encompassed in whole or in part within a proposed land division or condominium, the plan commission may require that such areas be dedicated or that restrictions, including conservation easements, be placed on the plat or certified survey map to protect such resources. The plan commission may further require that such areas be included in outlots designated on the plat or certified survey map and restricted from development, including those for common areas within conservation subdivisions. Conservation easements may be held by the Village of Hartland, a nonprofit conservation organization or another entity as approved by the village board.
