§ 6-66. Fermented malt beverage permit.

  • (a)

    General. A permit shall be obtained from the police department for possession or consumption of any fermented malt beverage within any village park as required under section 70-5. Where the possession or consumption of fermented malt beverages occurs as part of an organized gathering or assembly, the permit issued under this section shall permit possession or consumption of fermented malt beverages by all persons included in said gathering or assembly.

    (1)

    Possession and consumption of any intoxicating liquor or wine is prohibited.

    (2)

    Persons in violation of this section shall be given one warning by a police officer, who shall file a report of the warning at the police department. If a person again violates this section, a citation shall be issued to that person.

    (3)

    Upon issuance of a citation for violation of this section, the officer shall confiscate all fermented malt beverages and intoxicating liquor which the violator has in his possession. These beverages shall be kept at the police department for evidence and destroyed when no longer needed.

    (b)

    Permit fee. Persons applying for a permit under this section shall pay the required fee at the time of application.

    (1)

    Exception . A fee shall not be charged for permits under this section if the applicant has obtained another fee-based park use permit in connection with the specific event for which the fermented malt beverage permit is sought.

    (c)

    Issuance. The permit may be issued in advance of or on the same day as the event for which the permit is requested. The permit is valid only on the date it is issued for and expires at park closing time. The police department will retain a carbon copy of each permit issued.

    (d)

    Permit restrictions.

    (1)

    No permit shall be issued to any person under the legal drinking age.

    (2)

    Persons applying for a permit shall provide the following information to the police department:

    a.

    Name, address and phone number.

    b.

    An acceptable document showing proof of age, if required by the police officer.

    c.

    The date and approximate times being requested for use of the park.

    d.

    The make and license number of the applicant's motor vehicle, if any.

    e.

    The number of persons in the applicant's group.

    f.

    The applicant must sign a statement that he will be responsible for damage to park equipment or property, and that any litter caused by the applicant or by any members of the applicant's group shall be placed in the proper receptacles.

    (3)

    The permittee or his spouse shall be present while fermented malt beverages are possessed or consumed by the group covered by the permit.

    (4)

    The permittee shall have the permit on his person while in the park and during the event, and shall show the permit to any police officer or park board.
