§ 74-33. Building and construction site disposal and retention requirements.

  • (a)

    Waste and material disposal. Any person or contractor engaged in construction, expansion, maintenance, or remodeling activities shall properly dispose of all waste (including but not limited to garbage, rubbish, debris, cleaning wastes, wastewater, toxic materials or hazardous materials), recyclable materials, and unused building materials.

    (b)

    Waste and material, on-site retention required. Any person or contractor engaged in any construction, expansion, maintenance, or remodeling activities shall reasonably restrain all waste (including but not limited to garbage, rubbish, debris, cleaning wastes, wastewater, toxic materials or hazardous materials), recyclable materials, and unused building materials through use of closed containers or by securely fastening such waste or building materials to the ground or an immovable object, so that they will not be carried off the subject property by wind or runoff.

    (c)

    [ Applicability. ] For purposes of this section, a person or contractor shall be deemed to be "engaged in any construction, expansion, maintenance, or remodeling activities" from the time any materials are first deposited on the subject property until the time all work has been completed and excess and waste materials have been properly removed from the property and properly disposed of.

    (d)

    Contractor responsibility. Any contractor engaged in any construction, building, maintenance, or remodeling activity, shall be responsible for seeing that this section is not violated by the contractor or any of the contractor's agents, employees, subcontractors, or haulers of materials and supplies. If more than one contractor is involved in work which contributes to the littering of streets, sidewalks, pathways, or other public places in the same site or area, they shall be separately and jointly responsible for the observance of this division.
