§ 86-26. Definitions.

  • The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

    Municipal water system means a water system, owned and operated by a municipality, for the provision to the public of piped water for human consumption, if the system has at least 15 service connections or regularly serves an average of at least 25 year round residents daily at least 60 days out of the year. A municipal water system includes:

    (1)

    Any collection, treatment, storage, and distribution facilities under control of the operator of the system and used primarily in connection with the system; and

    (2)

    Any collection or pretreatment storage facilities not under control of the operator of the system that are used primarily in connection with the system.

    Noncomplying means a well or pump installation which does not comply with the provisions of Wis. Admin. Code NR § 812.42, in effect at the time the well was constructed, a contamination source was installed, the pump was installed or work was done on either the well or pump installation.

    Pump installation means the pump and related equipment used for withdrawing water from a well, including the discharge piping, the underground connections, pitless adapters, pressure tanks, pits, sampling faucets and wellseals or caps as provided in Wis. Admin. Code NR § 812.27.

    Unsafe means a well or pump installation which produces water which is bacteriologically contaminated or contaminated with substances in exceedance of the standards of Wis. Admin. Code NR ch. 812, or for which a health advisory has been issued by the state department of natural resources.

    Unused means a well or pump installation which is not in use or does not have a functional pumping system.

    Well means an excavation or opening into the ground made by digging, boring, drilling, driving or other methods for the purpose of obtaining groundwater for consumption or other use.

    Well abandonment means the filling and sealing of a well according to the provisions of Wis. Admin. Code NR § 812.26.
