§ 86-181. Generally.

  • (a)

    Title. This article shall be known, cited and referred to as the "Wellhead Protection Ordinance for Well No. 6".

    (b)

    Purpose and authority.

    (1)

    The residents of the village depend exclusively on groundwater for a safe drinking water supply. Village residents rely on a public water supply furnished by the village from underground aquifer sources. Certain land use practices and activities can seriously threaten or degrade groundwater aquifer quality, particularly the shallow groundwater aquifer. The purpose of this wellhead protection (WP) ordinance is to institute land use regulations and restrictions supplemental to the village land development ordinance in order to protect the village municipal water supply and well field and to promote the public health, safety and general welfare of the residents of the village.

    These regulations are established pursuant to the authority granted by the Wisconsin Legislature in Wis. Stats. § 62.23(7)(c), which specifically includes groundwater protection to the statutory authorization for municipal planning and zoning in order to protect the public health, safety and welfare.

    (c)

    Applicability. The regulations specified in this article shall apply within the boundary limits of the Wellhead Protection Area of Well No. 6, as defined herein.
