§ 90-41. Purpose and intent.

  • It is hereby declared to be the policy of the Village of Hartland, Wisconsin, to regulate and control the planting, transplanting, removal, maintenance and protection of trees and shrubs in the village in order to minimize and guard against dangerous conditions which may result in injury to persons using the streets, alleys, sidewalks or property of the village; to promote and enhance the many benefits, beauty and general welfare that the urban forest adds to the village; to prevent damage to any public sewer or water main, street, sidewalk or other public property; to protect trees and shrubs located in public areas from undesirable and unsafe planting, removal, treatment and maintenance practices; to guard trees and shrubs within the village against the spread of disease or pests. It is the intent of the village board that the provisions of this division shall apply to all trees, shrubs, or plants growing or hereafter planted in or upon any public right-of-way or other premises owned or controlled by the village.

    This division establishes policies, regulations, and standards necessary to provide a means by which the village will continue to realize the benefits provided by its urban forest. The provisions of this division are enacted to:

    (1)

    Establish and maintain the maximum amount of tree cover on public and private lands in the village.

    (2)

    Maintain trees in a healthy and non-hazardous condition through good arboricultural practices.

    (3)

    Establish and maintain appropriate diversity in tree species and age classes to provide a stable and sustainable urban forest.
