§ 46-924. Driveways.

  • All driveways installed, altered, changed, replaced, or extended after the effective date of the ordinance from which this chapter derives shall meet the following requirements:

    (1)

    Islands. Islands between driveway openings shall be provided with a minimum of six feet between all driveways and three feet at all lot lines, except that the plan commission is allowed to recommend approval of joint or shared driveways for all nonresidential zoning districts to the village board, based upon its determination that a joint or shared driveway is the best alternative due to site plan and immediate area considerations. The plan commission and village board may condition their recommendations and approval of joint or shared driveways upon the execution and recording of an agreement among all affected property owners establishing:

    a.

    Obligations to improve and maintain and pay for improvements and maintenance of shared driveway.

    b.

    Permanent ingress/egress easements.

    c.

    Whether and to what extent parking will be allowed on the shared portion of the driveway.

    d.

    Obligations to conduct and pay for snow and ice removal.

    e.

    Such other issues concerning the use of a shared driveway as are applicable to the given situation.

    (2)

    Openings. Driveway openings for vehicular ingress and egress shall not exceed 20 feet at the street right-of-way line and 26 feet at the curb line in single- and two-family residential districts; and shall not exceed 25 feet at the street right-of-way line and 32 feet at the curb line in all other districts. A wider opening may be approved by the plan commission, after a recommendation by the village engineer, to prevent a traffic hazard.
