§ 50-94. Submittal and transmission.

  • The subdivider shall prepare a final plat and a letter of application in accordance with this chapter and shall file an adequate number of copies of the plat and the application with the village clerk at least ten days prior to the meeting of the plan commission at which action is desired. In addition:

    (1)

    The village clerk shall, within two normal work days after filing, transmit:

    (a)

    Four copies to the Waukesha County Planning Agency;

    (b)

    Two copies to the Director of Plat Review, Wisconsin Department of Administration; and

    (c)

    Additional copies to the Director of Plat Review, Wisconsin Department of Administration, for retransmission as follows;

    1.

    Two copies to the WisDOT if the subdivision adjoins a state trunk highway or a connecting highway or proposes a street connecting to a state trunk highway; and

    2.

    Two copies to the DNR if lands lie within 500 feet of ordinary high-water mark of any navigable stream, lake or other navigable body of water, or if land in the proposed plat contains lake or stream shorelands.

    (2)

    In lieu of the procedure set forth in subsection (1) of this section, the subdivider may, pursuant to Wis. Stats. § 236.12(6), submit the original of the final plat directly to the Director of Plat Review of the Wisconsin Department of Administration who will prepare and forward copies of the plat at the subdivider's expense to the objecting agencies. When the subdivider elects to use this alternative procedure, it is the responsibility of the subdivider to submit sufficient additional copies of the final plat to the village clerk for reviews listed in subsections (3) and (4) of this section.

    (3)

    The village clerk shall also transmit copies of the final plat to the plan commission, village board, and additional copies to village staff, affected public or private utility companies, affected school districts, and SEWRPC.

    (4)

    The plan commission shall examine the final plat as to its conformance with the approved preliminary plat; any conditions of approval of the preliminary plat; this chapter and all ordinances, rules, regulations and comprehensive plan or components thereof which may affect it; and shall recommend approval or rejection of the plat to the village board.

    (5)

    If permitted by the plan commission and the village board, the approved preliminary plat may be final platted in phases with each phase encompassing only that portion of the approved preliminary plat which the subdivider proposes to record at that time; however, it is required that each such phase be final platted and be designated as a phase of the approved preliminary plat.
