§ 50-196. Sidewalks and pedestrian/recreational paths.

  • (a)

    In all land divisions and condominiums, the subdivider shall construct a five-foot wide concrete sidewalk on both sides of all streets within the land division or condominium and/or at such other locations in accordance with plans approved by the plan commission and village board. The construction of all sidewalks shall be in accordance with plans and specifications approved by the plan commission, upon the recommendation of the village engineer/DPW director.

    (b)

    In addition, wider than standard sidewalks or off-street pedestrian/recreational paths may be required by the village board in the vicinity of schools, commercial areas and other places of public assemblage, and the village board may require the construction of such facilities in locations other than those required under the preceding provisions of this chapter if such walks or paths are necessary, in their opinion, for safe and adequate pedestrian and recreational circulation. The village board, upon a recommendation of the plan commission, may waive the requirement for sidewalks or paths upon a finding that such walks or paths are not required because of the provision of a separate network of pedestrian/recreational ways, low vehicular or pedestrian traffic volumes or lot arrangement.
