§ 90-45. Authority over public trees.
The village shall have jurisdiction, direction, authority, control, and supervision over all public trees to plant, prune, spray, preserve, maintain, protect and remove or cause such work to be done as may be necessary to ensure the safety or preserve the beauty of public streets or grounds and to protect public sidewalks, streets, sewers and mains from damage or injury, and to prevent the spread of infections or diseases. The village board shall have the authority to make such rules and regulations as it may deem applicable for carrying out the purpose of this section.
(1)
Permit required. No person shall plant, transplant, move, treat, spray, brace, prune, disturb, alter, or do surgery on a public tree or shrub within the Village of Hartland until a tree work permit shall first have been obtained by the owner of the property abutting on the frontage thereof, or his authorized agent. Such permit shall be obtained from the village forester, and shall be issued only after the village forester has received a validated application for said permit.

Application for permit. Application for the tree work permit shall be obtained from the village clerk and validated by the village forester.
(3)
Compliance with vision clearance. No application shall be validated or permit issued unless the provisions of this Code requiring vision clearance on corner lots have been complied with.
(4)
Removal. As a condition of granting a tree work permit for the removal of a public tree or shrub, the village forester or his designee may require that the permittee plant one or more trees or shrubs in place of the one removed; a specific species, size, and location will be designated in the permit.
(5)
Fee. Unless installed under section 50-202 of this Code, any person, firm, or corporation intending to plant a tree on the public right-of-way shall submit an application for a permit and pay a fee of for each tree to be planted prior to receiving a permit. The fee shall be as established by the village board from time-to-time.
(6)
Inspection. Final inspection shall be made by the village forester within a reasonable time after the date stated on the application as the intended planting date.
(7)
Specifications. Applicants for tree work permits must comply with the specifications for planting, pruning and all work as set forth by the village forester.
