§ 26-26. Scope of authority to act.

  • (a)

    The area specified in Exhibit A is the only area within the village in which the community development authority is authorized to act. The board of trustees finds that this area is in need of the assistance that a community development authority can provide, but the board of trustees does not find the existence of such need in any other area of the village at this time. The authority of the community development authority to act or undertake projects in any other area of the village can only be acquired through an amendment to this article.

    (b)

    The community development authority is not granted the authority to act as the agent of the village in planning and carrying out community development programs and activities under the Federal Housing and Community Development Act of 1974, nor is it authorized to act as agent of the village to perform the acts which may otherwise be performed by the plan commission pursuant to Wis. Stats. §§ 66.405—66.425. The community development authority will be authorized to undertake projects relating to blight elimination, slum clearance, urban renewal and redevelopment programs proceeding under Wis. Stats. §§ 66.405, 66.43, 66.431, 66.435 or 66.46 only as expressly authorized by a resolution of the board of trustees on a project-by-project basis.
